Terms and Conditions

1. Definitions and Interpretation

In these Terms and Conditions, unless the context otherwise requires:

• "Company," "We," "Us," "Our" refers to Pubifa, registered at 15 The Drive, London, SW19 4JT.
• "Client," "You," "Your" refers to the person or entity engaging our plastic window installation services.
• "Services" means the supply, installation, and related services for plastic windows and associated products.
• "Agreement" means the contract formed between the Company and the Client for the provision of Services.

2. Service Scope

Pubifa specializes in the professional installation of plastic windows, including but not limited to:

• Consultation and measurement services for window installations
• Supply of high-quality plastic window frames and glazing units
• Professional installation by certified technicians
• Removal and disposal of old windows (where applicable)
• Post-installation inspection and quality assurance
• Warranty services as specified in the service agreement

3. Quotations and Pricing

All quotations provided by Pubifa are valid for a period of 30 days from the date of issue unless otherwise stated. Quotations are based on the information provided by the Client and site surveys conducted by our team.

Prices include:

• Materials and products as specified in the quotation
• Labor costs for standard installation
• VAT at the applicable rate

Additional costs may apply for unforeseen complications, structural modifications, or additional services requested after the initial quotation. We will notify you of any additional charges before proceeding with such work.

4. Payment Terms

Payment terms are as follows:

1. Deposit: A deposit of 30% of the total quoted price is required upon acceptance of the quotation to secure your booking and order materials.
2. Progress Payment: 40% of the total price is due upon commencement of installation work.
3. Final Payment: The remaining 30% balance is payable upon completion and your satisfaction with the installation.

Accepted payment methods include bank transfer, credit/debit cards, and cash. Payment details will be provided in your invoice.

5. Cancellation and Refund Policy

Clients may cancel their order under the following conditions:

• Before Material Order: Full refund of deposit minus a £150 administrative fee.
• After Material Order: Refund of deposit minus material costs and 20% administrative fee.
• Within 48 Hours of Installation: No refund available unless due to Company fault.

The Company reserves the right to cancel services due to unforeseen circumstances, in which case a full refund will be provided.

6. Installation Process

The Client agrees to:

• Provide clear access to all installation areas
• Remove any furniture, curtains, or obstacles that may impede the installation
• Ensure that pets and children are kept away from the work area for safety
• Be present or designate an authorized representative during installation

Pubifa will endeavor to complete installations within the agreed timeframe. However, delays may occur due to weather conditions, unforeseen structural issues, or other circumstances beyond our control.

7. Warranty and Guarantees

We provide the following warranties:

• Product Warranty: 10 years on plastic window frames and hardware against manufacturing defects
• Installation Warranty: 5 years on workmanship and installation quality
• Glazing Warranty: 5 years on sealed glazing units against failure

Warranties are void if damage results from improper use, unauthorized modifications, or failure to maintain the windows according to our care instructions.

8. Liability and Indemnity

While we take every precaution to protect your property during installation, Pubifa shall not be liable for:

• Pre-existing structural defects not identified during the initial survey
• Damage to decorative finishes immediately adjacent to installation areas (minor touch-ups may be required)
• Indirect or consequential losses arising from the installation

Our total liability under these Terms shall not exceed the total contract value for the Services provided.

9. Intellectual Property

All designs, specifications, and technical documentation provided by Pubifa remain our intellectual property. Clients may not reproduce, distribute, or use such materials for any purpose other than the contracted Services.

10. Data Protection and Privacy

We collect and process personal information in accordance with UK data protection legislation. Your information will be used solely for providing Services, maintaining records, and communicating about your project. We will not share your information with third parties except as necessary to fulfill our contractual obligations.

11. Dispute Resolution

In the event of any dispute arising from these Terms or the Services provided, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be resolved through mediation before pursuing legal action.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Amendments

Pubifa reserves the right to update these Terms and Conditions at any time. Changes will be posted on our website and will apply to all Services contracted after the date of posting. Existing contracts will remain subject to the Terms in effect at the time of agreement.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
